By accessing or using Lotly Auto (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including dealership administrators, team members, and demo users.
Lotly Auto provides a web-based vehicle reconditioning and inventory management platform for automotive dealerships. The Service includes features such as vehicle tracking, task management, analytics, DMS integrations, recall checks, and related tools.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
The Service is offered on a monthly subscription basis. Pricing is listed on our Pricing page. Some products have a one-time setup fee, shown on the Pricing page (Lotly Recon: $25). Pulse has no setup fee. All fees are non-refundable. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period.
You agree not to misuse the Service. This includes but is not limited to: attempting to gain unauthorized access, interfering with other users, transmitting malicious code, using the Service for illegal purposes, or exceeding reasonable usage limits.
You retain all rights to the data you input into the Service ("Your Data"). We do not claim ownership of Your Data. We may use aggregated, anonymized data to improve the Service, but we will never sell or share your identifiable dealership data with third parties.
The Service may integrate with third-party DMS providers (e.g., Frazer, AutoSoft) via SFTP, CSV import, or API connections. We are not responsible for the accuracy or availability of data provided by third-party systems. You are responsible for ensuring you have the right to share data from your DMS with our Service.
Recall information is sourced from the National Highway Traffic Safety Administration (NHTSA) public database. While we strive for accuracy, we do not guarantee the completeness or timeliness of recall data. Always verify recalls directly with the manufacturer or NHTSA.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Lotly Auto shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified terms.
We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.
